1. Overview

These Terms of Use (“Terms”) govern your access to and use of the websites, digital services, point-of-sale systems, and related offerings operated by Epic Mtn, LLC, doing business as Jackson’s Base Camp (“we,” “us,” or “our”).

By accessing or using our services, you agree to these Terms and our Privacy Policy, which is incorporated by reference.

2. Eligibility and Access

You must be at least 18 years old and legally able to enter a binding contract. You are responsible for all activity conducted through your device or account.

If you use our services on behalf of an entity, you represent you have authority to bind that entity.

3. Relationship to Privacy Policy

Our Privacy Policy governs the collection and use of Personal Data.
 In the event of conflict, the Privacy Policy controls with respect to data practices.

4. License and Use Restrictions

We grant you a limited, non-exclusive, non-transferable license to access our services for personal, lawful use only.

You may not:

  • Violate laws or regulations
  • Harvest or misuse Personal Data
  • Interfere with security or operations
  • Scrape, copy, or reverse-engineer systems
  • Misrepresent identity or affiliation
  • Use automated tools without permission

All content on our services is owned by or licensed to Jackson’s Base Camp and protected by intellectual property laws.

Unauthorized reproduction, distribution, or exploitation is prohibited.

By using our services, you consent to receive electronic communications (including email and SMS) related to your use of the services. Transactional communications may continue regardless of marketing opt-out status.

 We disclaim all warranties to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, Jackson’s Base Camp and its affiliates shall not be liable for indirect, incidental, or consequential damages.

Total liability shall not exceed $100 USD, unless prohibited by law.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the services or violation of these Terms.

10. Feedback

Any feedback you provide is non-confidential and may be used by us without compensation or restriction.

11. Modifications and Service Availability

We may modify, suspend, or discontinue services at any time without liability. We do not guarantee uninterrupted access.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Utah.
 Venue lies exclusively in state or federal courts located in Salt Lake City, Utah.

13. Dispute Resolution and Class Action Waiver

Claims must be brought individually.
 You waive any right to participate in a class action.

Claims must be filed within one (1) year of accrual.

14. Compliance with Laws

You are responsible for complying with applicable laws when using our services.

16. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance.

17. Miscellaneous

  • Assignment: We may assign these Terms without restriction
  • Severability: Invalid provisions do not affect remaining terms
  • No Waiver: Failure to enforce is not a waiver
  • No Relationship: No agency or partnership is created
  • Force Majeure: We are not liable for events beyond our control
